stand-by rate of pay

greenspun.com : LUSENET : Elevator Problem Discussion : One Thread

would appreciate any replies from my brothers on what your rate of pay is for stand-by work. sunday, ofcourse is doubletime but what rate of pay do you receive on a saturday? 1 1/2 or 1.7. the standard agreement is very vague on this subject so of course management is saying its 1 1/2 and the workers feel it's 1.7. what rate are you getting?

thankyou iuec brother

Hi Paul, The following comes straight from the Master Agreement. Both are from Article IX....

Par. 5. Call - backs on contract service on overtime, except Sundays and holidays, shall be paid for at the rate of 1.7 times the rate of single time. AND CHECK THIS FROM Par. 7. The rate of pay for overtime call - backs shall not be less than 1.7 times the straight time rate of pay. The premium pay described above is made in lieu of standby pay and in recognition of the fact that contract service employees agree to make themselves available for overtime calls.

AND DON'T FORGET THIS, ALSO FROM Par. 7. (c) It is understood and agreed that employees who are available to respond to overtime call - backs are waiting to be engaged (as defined by the Fair Labor Standards Act) by the Company. Employees who are waiting to be engaged are free to participate in personal activities; are not required to remain at home, at the Company's premises or any other specified location during the period that they are on call. Employees who are "on call" may leave the location they have indicated as the place of their primary contact. However, such employees will be available for callout by either leaving another phone number where they can be contacted or by carrying on their person a communication device such as a pager, cellular telephone, two - way radio, or other such communication device which enables the Company to contact them.

SORRY IF THIS IS LARGE, BUT IT SEEMS PRETTY CLEAR TO ME THAT IF YOU ARE ON A CALLBACK, WHETHER YOU ARE ON CALL OR NOT, THE PAY IS 1.7

Tell them you get 1.7 or they can get someone else to do stand-by. It is not requiered or can't be pushed on you in any form. Its extra for you and the company too. Think they gonna cut there $150 price for it NOT. Richard
