Drydens & B&B - SARN request, how should I respond?greenspun.com : LUSENET : Repossession : One Thread
Hi, I have been using this site for months and having followed the advice so far (after making mistakes early on before I find this site) I am now stuck! I sent a SARN to Drydens (twice) and they have responded to my recorded delivery second attempt like this:
They say they are not the Data Controllers and have forwarded my request to B&B who are. They claim that any correspondence etc between themselves and B&B is the subject of client/solicitor privilege, as defined by schedule 7, paragraph 10 of the 1998 Data Protection Act and pursuant to the Rule of Professional Conduct of Solicitors.
I know Drydens are registered as Data Controllers but am unsure how to answer this letter. Thanks to this site I feel I am progressing well so far but am stumped now. Any help appreciated.

We are in same position as you dealing with B&B through Drydens. Apparently solicitors are subject to 'legal privilege' and so will not tell you anything. You need to send a letter to Bradford & Bingley themselves, to their Data Controller, quoting your mortgage numer (no problems with this it just identifies who you are). They charge £10 and they sent us the stuff back quite quickly. Some of it is quite interesting, we have in fact had 3 different breakdowns!! If Drydens have forwarded your request on you may get a letter back from B&B quite shortly just asking for your account number - that's all you give them, no other information.
