Halifax and summary judgement

have appeared in court and LOST, judge has set another date for November to decide on course of action as I still refused to agree that we owed the debt !!!! have offer the Halifax a sum over three years stating that, that is the term of bankruptcy and they have now refused twice am wating for them to refuse on last time, then bankruptcy seems the only option as it appears they are set on going for attachment of earnings on hubby's salary. they are now using the WE HAVE WON IN COURT arguement to fight this out...any advice, also why are they intent on not accepting our offer and forcing us to bankrupt when they know that they will get bugger all from it?????

I am so sorry. I have no idea why they force people into bankruptcy, it's tantamount to being a malicious action in my book. I have heard that when they get this far they send a letter asking you to make a final offer - then accept it - almost like they have punished you like school children and now want to teach you a lesson. Disgusting.

You said you "lost" how so ? what was the verdict ? are you sure you lost ? I ask cos the judge is passing judgement in November, and you are still refusing to acknowledge the debt, how can he make a decision if you are refusing to acknowledge the debt. methinks that you need to remind him of his obligations under the CPR rules which means that he has to abide by the rules, check out the CPR Rules on the court service website. And you can tell the BS to wait until the judge makes his ruling before accepting any settlement. Have you got legal representation ? if not..then get some now !!!
