12 YEARS.....ARE THEY UP ???

I voluntarily handed in my keys in April 1990 to Abbey National on my flat.In late 1999 Eversheds got in touch demanding a 47K shortfall.No MJO has been made and 12 years has now gone by without me acknowledging the debt (I have been fighting a delaying action these last three years).Am I now legally clear of any liability ?

As far as I understand the 1980 Limitations Act then yes, you are. Are you still receiving demnads for payment from the lender? If so, why don't you write to them pointing out that their time has expired?

I shall put that to them in my next letter,I wanted to sound out opinions here first. I have been greatly encouraged by this forum over the last three years,which have provided me with much assistance.It's been the normal story.......pay us 47K or else.....followed by my repeatedly requesting documentary evidence,MJO,Mortgage Deed,details of marketing etc..to which they have not seen fit to respond to.I have also quoted the six year linitation,the HRA,harrassment.......at which they go quiet for a few months before re-starting their correspondence.....Bast**ds

I would also put it to them that as Abbey National are part of the CML you will formally complain to that body if they continue to harrass you as they are now time expired, and were in fact time expired when they first contacted you, and that all future correspondence will now no longer be responded to from this point forward. If they do contact you with same letter, send them a copy of your letter back over and over again. Good luck and fingers crossed.

Those rotters always carry on at you. See it there way a 30p letter for all the customer who pay even £1k let alone £47k - BAS**RDS.

I had big probs with too, and once you've paid and realised what a stupid thing you've done, they don't want to know and ignore YOUR calls. What trouble have you had? Keep ignoring them (best way I think) and drag it out. I settled and now complaining about the whole situ, because my wife and I got really stressed. In the end I caved in, wish I had not now. I wrote a complaint about my treatment and they just ignore me now.

BECAREFUL what you send to them, they use it ALL against you!
