Port of Seattle v. Lexington Insurance

The State of Washington’s Court of Appeals affirmed dismissal of the Port of Seattle’s suit for coverage of Y2K costs on May 28. The court found that while the port filed a timely suit, its computer systems’ inability to process four-digit dates was not a covered ‘virus,’ and sue and labor coverage did not apply because any date-processing problems were inherent defects.
