Curtis solicitors/Statutory insolvancy demand/RSA

greenspun.com : LUSENET : Repossession : One Thread

AFTER 4 MONTHS OF PEACE I HAD A RUDE AWAKENING TODAY FROM CURTIS SOLICITORS THREATENING ME WITH A SID AND BANKRUPCY OVER A MORTGAGE SHORTFALL BACK IN 1992. SHOULD I TAKE THIS SERIOUSLY AS ALL OTHER THREATS HAVE BEEN FALSE AND JUST THEIR TWISTED WAY OF GETTING SOME MONEY OUT OF ME. THEY GAVE UP ON THE CML ARGUEMENT BECAUSE THEY KNEW THEY HAD NO CLAIM, ESPECIALLY AS THEY CONTACTED ME AFTER THE CML DEADLINE. THEY SAY I HAVE 7 DAYS TO REPLY , BUT THIS SEEMS HARDLY FAIR AS BY THE TIME THE LETTER REACHED ME 2 DAYS HAVE ALREDY PASSED AND TODAY IS FRIDAY ,SO BY THE TIME MY SOLICITOR GETS MY RESPONSE 5/6 DAYS MAY HAVE ELASPED AND THEN HE HAS TO REPLY SO 7 DAYS IS A BIT SHORT NOTICE. SHOULD I IGNORE THIS DEMAND OR REACT TO IT IN FULL AS IT APPEARS TO BE A NEW APPROACH BY CURTIS & CO?

Hi there,

Yeah these are distressing. There's not a lot you can do to stop them threatening it but there is a lot you can - and should - do once they go ahead with it. You should also prepare as much in advance as you can because SID's don't leave you much time to respond.

So you should:

1. Read the material on how to deal with SIDs in this site's Do's and Don'ts section at: http://www.home-repo.org/dos/statdemand.htm

2. Get guidance notes and the response forms from the court before you receive the SID if possible - this so you know in good time where to go to deliver your response and what answers you are going to provide.

3. Post to this board using normal text not block capitals. Normal text is easier to read!

Good luck

Lee
