HOUNDED BY ABBEY/DAVIS & CO

Is anybody else out there being hounded by Davis&co on behalf of Abbey? I note from one or two other postings that Eversheds on behalf of Abbey accept the 6 year rule from date of sale, whereas Davis &co do not! Has anyone any written documentation stating Eversheds acceptance sic Abbey's acceptance of this rule,that I could use as a defence against Davus & Co?

This runs contrary to my understanding of Eversheds position on this topic, but then Eversheds tend to make things up as they go along. I wouldn't rely on any document from Eversheds to a third party as furthering my claim. If your debt is with Abbey, and Abbey say it's six years from sale, then you're cooking... the key being to get a statement from Abbey on the subject.

Anybody got any useful addresses at Abbey this person can write to for clarification?

Thank you, I actually did that this morning. I noted the excellent information on Limitation Act 1980 and the 6 year rule on the Home- repo pages and using that info asked them to clarify their statements. I wrote(recorded delivery)to the Secretariat, Abbey National, POBox 911,Central Milton Keynes,MK9 1AD, if anyone else wants the address, asking for Abbeys's policy on the above. I also asked them to explain their underselling of the property, when a buyer was found privately 3 months earlier at full price and they accepted a loss of 60% on the selling price. I eagerly await their response and discovery of info from the SARNs to Abbey and Davis&Co.

I agree with above,it is significant that davis and co are in the same building as First national bank and always act for FNB who are not a nice company to deal with when in trouble.Owned by?................you guessed it Abbey National.One can but wonder if they have a fiscal link to Davis as well!The Abbey HAVE TO follow the mortgage code of conduct rules and thats final re 6 year rules
