McVeigh Could Go Free Due to FBI Bungle, Says Law Professor

While most legal experts say the bombshell news that the FBI witheld evidence in Oklahoma City bombing case won't alter Timothy McVeigh's ultimate fate, at least one prominent law professor argued Friday that the government's case against the confessed bomber may have been completely compromised.

Georgetown University law professor Paul Rothstein contends that FBI bungling may not only save McVeigh from execution, it could set him free.

Rothstein was one of several legal experts who told the New York Post they believe McVeigh might now win a new trial. Citing his comments, the paper reported Saturday:

"If the courts decide (McVeigh's first) trial was tainted by the FBI, this would trigger 'double jeopardy' and McVeigh could not be retried."

Rothstein was a high-profile defender of disgraced ex-president Bill Clinton during the Monica Lewisnky scandal, making dozens of appearances on cable TV arguing Clinton shouldn't be impeached.

Stephen Jones, McVeigh's lead attorney when the case went to trial in 1997, told reporters that his former client would be "in the catbird seat" now, if he had taken his advice not to confess.

"I always told him he should keep his mouth shut and not to waive his appeals," Jones said.

The guy is absolutely correct, they can't convict someone twice for the same crime. Of course Newsmax takes the typical ignorant rightwing perspective that they always do, trying to make it look like there is some kind of agenda by Democrats to set him free.

Remember how this all started though... McVeigh was inspired by the rhetoric of rightwing conservatives who feel they have the right to kill innocent people to avenge the government for something that the nutcase David Koresh caused.

Not exactly. Rather, he was inspired by leftwing conservative Unabomber, who felt he had the right to kill innocent people, including government officials.

We may never know who REALLY inspired the actions of Tim McVeigh, but radicals of his ilk live on both ends of the political spectrum. I suspect that the longer he lives, the more nervous some very important people will be. He is just one piece in a large puzzle.

Not really. Liberals may protest and do some weird shit, but the really dangerous killer types are always wacko conservatives. Their paranoia of the government or people who are different than them becomes their entire reality, it feeds on itself until they become obsessed. Since they are too stupid to see that they have a mental problem, they believe the only solution is to kill the people who they think are out to get them.
