I think this is referring to a court case coming up in Leeds County Court. An unnamed ex borrower is fighting the shortfall claim against him using the Limitation Act, claiming that the lender has 6 not 12 years in which to pursue for the alleged 'debt' (see under Repossession, 6/12 year rule, this web site). This issue has still to be tested in the Court of Appeal, so it would be useful if this one would go 'all the way'.

The ex borrower's solicitor is Joseph Aaron of Ilford. (Joseph Aaron and Co, City Gate House, 399-425 Eastern Avenue, Gants Hill, Ilford. Tel 0208 5180333, fax 0208 5184560.) He is a chartered insurance practitioner, so is an insurance expert as well as a solicitor.

It will be very interesting to see how this case develops. With any luck, Mr Aaron will also be taking an informed interest in the MIG scandal soon as well.

I have a copy of the case report at home, long and dull as usual and yes the good guys lost. However, the defense case was, IMHO, a load of old rubbish and I am not suprised they lost!!

Matt I am sure everyone who reads the site would really appreciate it if you could give more detail on the case ie the arguemnts used etc. Pardon my ignorance, but what is "IMHO"? Was there any press comment on this result, that you know of? George
