These Regulations wee made under the Regulation of Investigatory Powers Act 2000 and set out the circustance in which employers can intercept your e mails and telephone calls etc without your consent. I don't see how it could. The right of privacy would be the only real runner and presumably a business monitoring employees' use of systems that are provided for business purposes isn't a breach of privacy. It's not like they are being allowed to bug your home phone. There are protections - businesses will have to make Internet/ e mail policies I believe.

So it probably isn't a good idea to go up to the System Administrator and ask what his policy on internet/e-mail abuse is!!?

Fair enough, but, as mentioned most companies do operate a policy where the internet and e-mail should only be for business use. I know we do. Now this may be an interesting thought, if a company is checking e- mail for non business use, and you are found to have been abusing the system, would this be a privacy issue or since the e-mail is on company equipment, ie the mail servers, do the contents of your mailbox also belong to the company, so they can do what they want with it?

I think that since they own the kit, then they "owN" whatever's in your inbox for the same reasons as they can prescribe what you can and can't do with the facilities they provide for business purposes. Remember that should you libel someone or commit some other tort or even a criminal act, there would be vicarious liability issues as well as massive embarrassment if your employer was hauled in.
