Apparently AP took offense to their pictures being used on that site. This is now what you find when you go there... we recieved this, so the site is gone. sorry.

I'm David Tomlin with AP.

We've already written the Geocities copyright agent about your unauthorized defacing and display of AP pictures on your site there.

I'm writing now about the display at: http://www.newgrounds.com/portal/view.php3?id=266

You are exposing yourself to liability for copyright infringement that can include both fines and possible criminal penalties. We'll go for whatever it takes to get our material out of your hands. Please acknowledge immediately that you understand and are taking down the display of AP pictures at the address above.

Did anybody save a copy of it? They can't stop us from downloading it if we want to run it on our own computers, as long as it isn't "published".

-- Hawk (flyin@high.again), April 27, 2000.

Hawk,

I emailed it to my hubby, I'll check to see if he saved it and get back to ya.

Darn, censorhit. opps ship....

-- consumer (shh@aol.com), April 27, 2000.

I saved it. If you still have it in your cache, look for the file elian.swf and save it to your hard drive. Leave your email address and I may send you a copy.

At least temporarily, the video is also located at the URL referenced in the AP letter...

Thanks for the help @ and consumer! I found it in my cache and got a good copy saved. That's a good one!

Those people who are threatening to sue are really being jerks. The animation does not favor any political viewpoint or do anything to depreciate the value of the original photos. It is a work of art.

On the other hand, they don't seem to be bothered by the fact that the photo is being used to undermine the law of this country by slanderously accusing the Federal government of "child abuse". For them to allow people to display the photo in this context, and even profit from it by selling t-shirts for $10, is downright traiterous. They hypocrits at AP should be sued for slander.

CNN has printed an article about this...

Whazzup? AP tries to kick popular Elian animation off the Internet

April 27, 2000 Web posted at: 4:33 PM EDT (2033 GMT)

By Richard Stenger CNN Interactive Writer

(CNN) -- An animated parody of the Budweiser "Whazzup?" commercial using the principal parties of the Elian Gonzalez saga has disappeared from the Internet due to legal threats from The Associated Press.

Elian, along with Fidel Castro, Janet Reno, Gonzalez family and friends and a camouflaged federal agent lip synch the lines from the popular Budweiser television ad in a flash animation, posted days ago on sixsite.com and other Web sites.

But the creator of "Stormtrooper True" used AP photos for the animation, including the now famous image of an armed agent confronting Elian and the fisherman who rescued the boy, drawing the ire of The Associated Press, whose photographer took the photo.

Viewers going to a Geocities site that posted the satire saw an unexpected sequel instead Thursday afternoon: a cease-and-desist warning from The Associated Press.

"We've already written the Geocities copyright agent about your unauthorized defacing and display of AP pictures on your site there," AP representative David Tomlin wrote.

"You are exposing yourself to liability for copyright infringement that can include both fines and possible criminal penalties. We'll go for whatever it takes to get our material out of your hands. Please acknowledge immediately that you understand and are taking down the display of AP pictures at the address above."

"Stormtrooper True" was taken down, but not before logging well over 800,000 hits and showing up at several other sites, as well as being passed around through e-mail. Tomlin's warning gives the URL of a second location that has also been taken down.

Regarding possible copyright infringements, Yahoo, which owns Geocities, reserves the right to terminate the accounts of users who violate intellectual property rights.

Tomlin could not be reached for comment. But Sean Bonner, who said sixsite.com is his site, suspects "tons" of other sites have posted "Stormtrooper True" since he first did Tuesday afternoon.

Bonner, who said he created the animation with Chris Lathrop "in a half hour or so," said he would include links at his site to other Web addresses that still have "Stormtrooper True" posted.

I guess David Tomlin is the one that didn't get the sense of humor genes that were passed along to Lilly?

-- Anita (Anita_S3@hotmail.com), April 27, 2000.

LOL Anita! Lilly Tomlin, wow, wasn't she great!

David is undoubtedly one of the insurrectionists who would like to destroy the current "satanic" administration by fabricating lies about their motives, so any sense of humor about this incident would ruin the credibility of his agenda.

Let's try again!

I give up on the Hot Link. Try this URL:

Yes, Flash, that is the "wazzup" clip. Since the time that AP requested the clip be pulled from the original website it has popped up on a number of different locations - INCLUDING playboy.com

This has become something of a story as it has been mentioned by a number of media outlets including cnn.com, cbs.com, wirednews.com and playboy.com. (I even heard a brief comment and replay of it on MSNBC tv today.)

For the latest info along with links to other sites which are hosting the clip go to it's original homepage...
