Kosovar refugees due to return home today will remain in Australia for at least another day after technical problems with the plane chartered to fly them from Melbourne.

Immigration Minister Philip Ruddock said he was disappointed at the delay but he hoped 168 refugees would be flying home tomorrow.

Thirteen of those originally due to fly home today have been given longer extensions.

Seven of those have been given medical extensions and can expect to stay to the end of the month.

Two families of three have had the bar lifted allowing them to make a refugee application.

It is expected that the refugees due to fly tomorrow will remain in their safe havens around Australia before flying to Melbourne to catch the charter flight to Bulgaria.

The fate of 65 refugees will be decided by Chief Justice Murray Gleeson at the High Court on Monday afternoon.
