Title: Synchronics Gets Y2K Judgment In Action Over Noncompliant System

A federal court granted summary judgment to Tennessee-based Synchronics Inc. on Feb. 25, rejecting warranty, contract and fraud claims brought over a noncompliant business management software system.

Peerless Wall and Window Coverings Inc. sued Synchronics over a customized version of RealWorld's "Point of Sale" software used to manage inventory and link several home decorating stores in the Pittsburgh area. The case was brought as a class action, but the U.S. District Court for the Western District of Pennsylvania denied class certification without prejudice earlier in the litigation.

In the Feb. 25 order, Judge D. Brooks Smith first dismissed Peerless' breach of warranty claim, noting that a company officer signed a software registration form saying she had read and agreed to the licensing terms. That agreement bound the parties to a 90-day warranty -- and on the diskettes and user manual only, the judge noted.
