On January 18, 2000, at 11:00 a.m. MST, Federal Bureau of Investigation Agents seized tribal financial records for 1998 - 1999. The federal agents were brought in by the Grass Roots Oyate, a group of concerned Oglala Sioux tribal members who took control of the tribal office on Sunday, January 16, 2000. Their sole purpose for this takeover is to protect files that incriminate the Oglala Sioux Tribal Treasurer, Wesley "Chuck" Jacobs and several Oglala Sioux Tribal Council Members.

Upon vacating the Red Cloud Tribal Building, FBI Agent-In-Charge William Grode stated that they will be travelling to Allen, South Dakota to the Oglala Sioux Tribal District Office to seize records there. Dozens of concerned community members in the Allen community are guarding the building prohibiting any tribal district elected officials from entering the building to tamper with files.

FBI Agent-In-Charge William Grode also informed the Grass Roots Oyate that warrants have been issued and agents are en route to the First National Bank of Gordon in Gordon, Nebraska to seize financial records involving the Oglala Sioux Tribal accounts. First National Bank of Gordon has been the Tribe's primary bank for fourteen years.

Agent Grode informed the Grass Roots Oyate in a meeting on January 17, 2000 that a grand jury investigation has been underway for some time. With today's seizure, the agent stated that indictments are sure to follow soon.

The Grass Roots Oyate have re-occupied the Tribal Office and will remain there until the Oglala Sioux Tribal Treasurer Wesley "Chuck" Jacobs and several of the Oglala Sioux Tribal Council Representatives are removed from office.

Tribal Council Representatives have retaliated by putting in a request to U.S. President Bill Clinton and South Dakota Governor Bill Janklow to remove the Grass Roots Oyate from the tribal office using "deadly force if necessary".

Several others tribes have phoned in their support of the actions of the Grass Roots Oyate and are considering if they should take similar action on their reservations to deal with widespread political corruption.

When are the different tribes in this country going to realize this is one great nation and not many nations within it. Those of us who were born in this country are all Native Americans. That includes Negroes, Latinos, Chinese, Japanese, Jews, Germans, and many many others. If the U.S.Army hadn't defeated the tribes in the 1800's,this great country would have been annexed to Mexico in very short order.They would have shown absolutely no sympathy toward treaties at all. If Mexico wouldn't have been victorious, Hitler would have met the Japanese Imperial Army in the middle of Kansas and the surviving tribal members would have been boxcared to German concentration camps in Colorado and they would be as numerous as the dinosaurs. We are free people living in the best country on earth because history evolved in this way. We are all Native Americans and proud to be so!

NOTICE FROM OCCUPIED PINE RIDGE OFFICE What is happening at Pine Ridge is strictly an internal situation of the Oglala Sioux Tribe. If everyone leaves it alone and keeps their own agendas out of it, the Oglala People will handle it just fine. I hope that happens. The so called "news blackout" is just a case of nothing happening that interests the various news agencies very much. There have been news reports coming out now for over 24 hours. It is hardly a case of the Rez borders being shut down. The Feds were asked by the protesters to be there and sieze records. This is not a case of another Wounded Knee occupation with APCs manned by wasichian surrounding a lot of skins. The protesters are following the elected president of the Oglala Tribe. Many of them are active leaders in the tribal government. They know how to handle things just fine without outside meddleing. The latest reports say that the protesters have NOT asked for outside support and for everyone to chill. Oglala politics can get rough and tumble, so this is not to say that everything is going to be nice and calm - but outsiders getting involved can sure make it worse, just as it did back in the troubles of the 70s and the Wounded Knee Occupation. Again, this is an Oglala vs. Oglala tribal matter. It is not Indian vs. whites, Indian vs Feds or anything like that at all - for now anyway.

--well, good. Guess we'll all just read about it. Wonder how long an "occupation" of-say, just for theoretical example-a Fed reserve bank would be tolerated by das authorities. Plenty of historical shenanigans going on in any of those places. Talk about corruption and money manipulation and rip offs! Strange that the USA State Department agrees with the United Nations that Canada is the best country on earth for standard of living and - oh my! - personal freedoms.

Point taken about "native", it's a poor semantic choice. But "indigenous" and "aboriginal" don't work either except for Africa, so you're left with First Nations or you could, just maybe, try and actually learn the tribal names.

Is it just me, or are you suggesting that these pre-European North Americans (or insert your own pigeonhole description) should feel grateful that their ancestors were treated - and butchered - like animals, and ravaged by European diseases? Should they just accept that they have dreadful prospects in trying to live a European American lifestyle because of prejudice, and that they can no longer choose to live a truly traditional lifestyle because their culture was deliberately and methodically destroyed in the early 20th century? Should they nod and agree that might makes right, and it was all done for their own good?

That argument doesn't work. Not in the USA, not in Northern Ireland, Scotland, Kosovo, the Balkans, Quebec, Basque, Africa or Tibet, to name but a few. And the more you arrogantly dismiss the heartfelt grievances, the stronger the opposition will become. I speak from first hand experience here.

Your mistake was in not wiping out all of the pre-European people. You nearly, nearly did it in near the last century rollover, but you didn't quite manage it. Now, unless my recollection of ancient and contemporary history is way off, it won't be you that gets the last laugh.

Regarding the recent occupation of the Pine Ridge government offices by protesters, a personal statement of support seems to be in order, from one Grass Roots person to a group thereof...... +++++++++++++++++ Please contact your representatives and send them the following to bring the situation to their immediate attention. Dear __________,

This is to bring to your attention a situation which concerns me as a voter.

I, _________, a citizen, taxpayer and voter of the United States of America, which nation has treaty obligations to the Oglala Lakota Nation, support the demands of the Oglala Grass Roots Oyate (People) and the traditional elders f the Lakota, who are involved in a non-violent, peaceful assertion of their rights in the tradition of Dr. Martin Luther King.

As a US taxpayer and citizen, I feel my statement of support is appropriate especially in the case where these demands pertain to the investigation of corruption regarding the malfeasance of funds obtained from the United States, and also appropriate especially as regards their demands that the United States observe and honor Indian treaties, as these are incorporated into the law of the land of the United States.

I support full US Government cooperation in the investigation of any and all governmental misconduct past and present, both in regards to the Lakota elected officials and those officials of the United States, as it is requested by the Grass Roots Oyate and the traditional leadership of the glala, all the while with full respect to the sovereignty of the Lakota.

I would strenuously object to any attempt at a cover up, lack of investigation, or "going through the motions" that might undermine the right of these people to have a fully accountable elected government in a form of their own choosing, as this is counter to the principles upon which our nation was founded and to the spirit in which the treaties were affirmed.

A statement from the Oglala Grass Roots group, including their demands follows:

January 17,2000

RED CLOUD TRIBAL BUILDING, PINE RIDGE INDIAN RESERVATION, SOUTH DAKOTA: On January 17, 2000 at 10:00 am, a group of concerned Grass Roots Oyate (people) met with representatives of the Federal Bureau of Investigation to etermine what action, in any, the Federal Government will take against the corrupt Oglala Sioux Tribal Treasurer and Council Members.

Hundreds of tribal members filed into the cramped office space to tell their stories to the federal agents. Stories of land stealing, homelessness, poverty, tribal law enforcement abuses, lack of accountability from elected officials. Two hours later, the FBI agents were growing weary and requested a break to speak with media on the scene.

The Grass Roots Oyate took control of the Tribal Office on Sunday, January 16,2000 for the sole purpose of protecting the files from tampering. The Grass Roots Oyate, consisting of tribal members-young and old, have stated that they will retain control of the building until their demands (see attached) are met. This group feels that this action is long overdue and has demanded the immediate removal of Oglala Sioux Tribal Treasurer Wesley "Chuck" Jacobs for gross misconduct and mismanagement of tribal funds.Additionally, the Grass Roots Oyate is seeking the removal of Tribal Council Representatives who are involved in the corruption of this tribal government.

At the close of today's meeting, The FBI agents informed the Oglala people that they have acquired some financial records already from unnamed sources and an investigation is underway. They stated that they are not at liberty to elaborate on this investigation but added that they are investigating various programs within the Tribe and they hope to conclude this process soon.

The FBI stated that they will return to the Red Cloud Tribal Building on Tuesday, January 18, 2000 to hear further testimony. (They did, and took all finacial records into safe-keeping as requested by Grass Roots Oyate--all was peaceful).

1.Full forensic audit of all OST income including Prairie Wind Casino. This audit must be made public to all Oglala Sioux Tribal members.

2.Enforcement of the OST Constitution & By- Laws; Specifically to Article X- Land: Section XI Use of Unassigned Land. Any income derived from such land shall accrue to the benefit of the Tribe as a whole. That those funds be set aside and distributed equally to each district. ($200,000,000 ).

3.Under the IRA ( Indian Reorganization Act), Section 5 provides for the recovery of tribal lands that the Secretary of Interior shall exercise this right in purchasing all land, water rights and surface rights to land within or without existing reservation and turn over OST trust land. Under his provision the Secretary of Interior shall pay to FHA the outstanding balance of land purchased under the FHA loan, further that the Secretary and United States Congress return to the Oglala Sioux Tribe, land known as the Buffalo Gap National Grass Land, and all other that Section V of IRA (Indian Reorganization Act), states and carry out to the fullest extent of this section.

4.Secretary of Interior do whatever is necessary to return jurisdiction to the Oglala Sioux Tribe in Bennett and Jackson Counties. 5.That the U.S. Government honor our sovereignty and refrain from all things that they do, such as, involving the State in any and all actions. The U.S. Supreme Court has ruled that the Oglala Sioux Tribe is a sovereign nation within a nation and the supreme law of the land. The Tribe has the right to negotiate government to government which excludes the State. That the U.S. Government enforces and abides by all treaties and rights of the Oglala Sioux Tribe.

6.Secretary of Interior will honor and see to this trust as trust responsibility on Oglala Sioux Tribal land, known as "The South Unit", under the General Management Plan Revision/Development, which was signed and approved the OST Council, Dir. Of Rocky Mountain Region, Dir. Of National Park Service and the Secretary of Interior on 1/2/76. The South Unit land belongs to the Oglala Sioux Tribe.

7.The OST Council has violated their Oath of Office to the US Constitution and OST Constitution, therefore all council members and the OST Treasurer are to be removed from office immediately, in the best interest of the OST and its members.

8.All funds owed to programs be paid back in full immediately and programs be left to administrate their programs effectively, without interference from tribal government, except where otherwise stated in the program contract.

9.A full land audit be conducted on the First National Bank of Gordon, Gordon, Nebraska to determine how much tribal land they have obtained as collateral for bailouts, etc.

Urgent Report I just spoke with Elainne Janis at the Red Cloud Tribal Building in Pine Ridge. They are still in meetings at 10 minutes till 8:00 January 19, 2000.

They have been meeting all day with the Civil Rights Commission and the Court House earlier today. Tomorrow morning at 10:00 they are to be in court concerning getting the order to remove Wesley "Chuck" Jacobs as Treasurer of the Oglala Sioux. The Occupation People are asking that any person. Whether they are AIM or not to please come join with them for a march to the courthouse tomorrow morning. They want a complete show of strength in the morning as they plan to call the Judge out to see how many individuals are supporting them in this cause. If you believe I have historical errors in my posting, then why don't you point them out one by one. Most of my statement pertained to 'what ifs' and not to what actually happened except for the U.S. victory over tribes. That is a fact and well documented. If this hadn't have taken place the scenarios I pointed out would have very easily occurred! On January 19, 2000, at 2:00 p.m. MST, U.S. Department of Justice Mediator Silke Hansen, Oglala Sioux Tribal (OST) President Harold Salway and Bureau of Indian Affairs (BIA) Superintendent Robert Ecoffey met with the Grass Roots Oyate, a group of concerned Oglala Sioux Tribal members who took control of the tribal office on Sunday January 16, 2000. Their sole purpose for this takeover is to protect files that incriminate The Oglala Sioux Tribal Treasurer, Wesley "Chuck" Jacobs and several Oglala Sioux Tribal Council members.

The Grass Roots Oyate demanded explanations from OST President Harold Salway as to why he rescinded his suspension of OST Treasurer Wesley "Chuck" Jacobs for gross misconduct and mismanagement of tribal funds. President Salway exercised his scope of authority under OST Ordinance 62-10 which allows the President to suspend an officer pending a termination hearing before the OST Council. In a OST Executive Board meeting on January 18, 2000, OST Tribal Attorney, Marvin Amiotte rendered a legal opinion stating that the OST Constitution supercedes ordinances. Therefore, president Salway stated that he had no choice but to rescind his order of suspension.

BIA Superintendent Robert Ecoffey stated that the Grass Roots Oyate should "work with the Council for the rest of the term and find solutions to the issues at hand".

Grass Roots Oyate member, Harvey White Woman recalled a comment made by OST Treasurer Wesley "Chuck" Jacobs at a October, 1999 "March for Accountability" held in Pine Ridge Village. On a live KILI 90.1 fm radio address Jacobs stated, "If the people don't Want me, I'll resign!" The Grass Roots Oyate are demanding he keep his commitment And resign.

On January 20, 2000 at approximately 9:00 a.m., the Grass Roots Oyate will be Marching from the Red Cloud Tribal Building to the "Moses Two Bulls" Tribal Courthouse for a 10:00 a.m. hearing to suspend OST Treasurer Wesley "Chuck" Jacobs And have him removed as signatory at the Ost's primary bank The First National Bank of Gordon, Nebraska. In a radio address, the Grass Roots Oyate encouraged tribal Members reservation-wide to join in the march.

On January 20, 2000, the Grass Roots Oyate appeared before the Oglala Sioux Tribal Head Judge Patrick Lee in a hearing for court order to remove the Oglala Sioux Tribal Treasurer as the signatory at the First National Bank of Gordon, Nebraska. At approximately 3:30 p.m., the ruling was made in favor of the plaintiffs, the Grass Roots Oyate.

The Grass Roots Oyate is comprised of large number of Oglala Lakota Sioux that took peaceful control of the Red Cloud Tribal Building on January 16, 2000 for the sole purpose of protecting financial records that incriminate the Oglala Sioux Tribal Treasurer Wesley "Chuck" Jacobs and Oglala Sioux Tribal Council Members.

The Grass Roots Oyate are demanding the immediate removal of the Tribal Treasurer for years of gross misconduct and mismanagement of tribal funds allocated to the members of this great nation. Furthermore, they are seeking the suspension of the entire Oglala Sioux Tribal Council pending a referendum vote of the entire nation. We, the Grass Roots Oyate have witnessed many improprieties of Tribal Council Members. They have repeatedly violated their oath of office and their IRA Tribal Constitution.

Today, the Grass Roots Oyate will be submitting resolutions to the Secretary of the Interior demanding the following: 1. The suspension of the Tribal Council pending a referendum vote; 2. Request to have the Bureau of Indian Affairs assume temporary administrative authority to maintain critical financial services such as medical assistance, funeral services, and payroll.

Additionally, the group is submitting a request to the Senate Select Committee on Indian Affairs step in and takeover the investigation into the widespread corruption within the Oglala Sioux Tribal government.

Due to reports received early this morning, the Grass Roots Oyate have barricaded themselves in the Tribal Building in an effort to protect the women and small children and elderly men and women inside. The group took control of the building in a peaceful manner and have a sacred c'anupa (pipe) inside the building. It is not the intent of the Grass Roots Oyate to incite violence. However, Gerald "Jump" Big Crow, Tribal Council member has attempted to gain access to the building on two occasions and has threatened physical violence.

Today the Department of Justice Representative Silke Hansen has requested a meeting between the Tribal Council and the Grass Roots Oyate to negotiate on our demands.

The Grass Roots Oyate stand by their beliefs that their demands are non-negotiable. The Tribal Council should know that until OST Treasurer Wesley "Chuck" Jacobs is removed and other demands are met that the Grass Roots Oyate will continue to maintain a peaceful monitor over the files in the Tribal Building.

The Grass Roots Oyate are currently experiencing a media black-out on the Pine Ridge Reservation. They stated that any assistance to get this press release out to the international community is greatly appreciated.

I received an email about 45 minutes ago asking me to call the Occupation Peoples at my earliest convenience. I went to call and the phones have been disconnected. I sent them an email asking for another contact number and advised them the phones were down. The reply from Pine Ridge is as follows Our phones have been disconnected. I do not know what we are going to do. we are getting nervous about the situation.Rumors that we are now being under attack are coming true. Can someone get a hold of the FCC in Washington. In case anyone hasn't gotten the answer from another forum (there are a lot of them!), the situation with the utilities was resolved peacefully. Utilities were restored by court order. The federal mediator returned. Seems this was Jacobs doing.

Security is tight, but the situation is under control. I understand there are also roadblocks near the building because of the threat of drive-by shootings.

I repeat, everything has been peacefully resolved. The alert worked as it was supposed to. Keep writing to Washington and your representatives. Keep sending relief supplies.

BTW, the latest in requested supplies includes thermoses and warm gloves/scarves for those outside guarding the building. Also batteries, blankets, toilet paper and sanitary supplies.
