OT: Posting of credit card late fees

Was thinking maybe someone could clarify something for me. Several days back I remember reading a post and follow ups regarding the First USA credit card - talking about late fees and such and how awful they are (1st USA). I thought someone said that they cannot legally post a late fee if the payment is POSTMARKED on or prior to the due date. Is that true?

I was told once by another creditor that you should mail your payment at least a week in advance to give time for processing. To me, that doesn't really make sense. What matters is they have the payment on premises. Anybody know? Thanks.

It was my understanding that postmarked mail only worked for the IRS, but not credit card companies. This may not be an O.T. question if it turns out the post office is having problems. (But I got bills today, pretty fast. Rats.)

Hey Nutty -- I think it depends on the state. Our state sez if it's postmarked, it's cool. Alot of ppl don't know about this advantage in paying bills. Check your state rules. Start with the general state info # in your phone book....hahahaha....and then plan to spend the day goin through all the transfers.

A Captain in SLED (police narc dude, S.C.) told me it is a federal law. He uses it when needed. I used it myself on Providian (yuck!). My last payment I screwed up; it was 5 bucks short (oops) so they dropped the dime to call me and confirm my next payment which is due 1/9. They (he) wanted to know what day I was gonna mail it, and this was still Dec so I said I wanted to wait till after new year to make sure my auto-pay deposit is confirmed. Anyway, he kept pushing for me to commit to a date, so I informed him that it would be mailed by the 9th and BTW fed law requires credit agencies to acknowledge/credit the payment on the account by the postmark on the envelope...He said his company and state law was blah blah...I interrupted him to inform him that it is illegal for his company policy to supercede federal law, and it was terrible that he wasn't appropriately trained on this, and he should go talk to his boss about this to be brought up to speed. End of conversation. Capt says it works every time, cause these credit companies are in alot of heat for illegal AND unethical practices, and if you know your rights and call them on it then they shy away, cause they're aware that the feds are pissed at their BS.

Capt figures this law is in response to credit agencies abuse of customers by entering receipt days after they cash your check, just to slap on a 25 to 35 dollar late fee.

Hi nutty My credit card bill was due Tuesday 1/4/99 I tried to enter on-line Saturday 1/1/00 The software will not accept payments on weekends or if the banks are closed. I do not know yet if I got a $35.00 late fee from those rat bastards.
