I am 6 months in arrears with Mortgage from Abbey National. My house is up for sale, I am hoping to complete in the next 2-3 weeks. I have had a letter from ANs solicitor threatening that if I do not pay all arrears, I will be repossessed. Also, that any legal charges will be added to the mortgage balance.

I have sent them 2 letters by recorded mail, both times they have been signed for, but I have not had any reply. In the letter I have told them that my house is under offer etc and that the loan will be paid off within the month.

Can they demand I make a payment in the next 2-3 weeks, can they add money to my existing loan, where does this leave me? I am worried that the house sale might fall through and then AN will take the property off me

Answering your questions in order:

>Where does this leave me? That depends on what happens with your sale. You'd probably need to see a solicitor or the CAB if the sale falls through.

Hope this helps. Sorry it is not much but a lot depends on that sale. Be aware that judges don't like lenders that try to repossess a customer that is trying to sell so they may not be able to repossess you as easily as they say they can.
