Acoustic Separation

More of a philosophical question than one of legal interpretation. Is the structuring of opinions this way (w/ acoustic separation) disingenous? Or is it simply a subtle way for courts to stake a position in policy arguments while potentially maintaining unpopular, but perhaps legally efficient, standards in the less publicized realm of the trial court? Sorry if this is not the most eloquently written question.
