8 1/2 hour days?

Is it legal for an employer in California to interview a new employee and require a 7:30am - 5:00pm day? With an 1hr lunch that is 8 1/2 hour day, and with a 1/2 hour lunch, that is a 9 hour day. Must an employer tell the interviewee whether or not they are exempt from overtime during the interview process? If they say you are exempt, isn't the company breaking the law of an 8 hour day, 40 day work week?
