I don't want to build up any false hopes but I got in touch with the National Debtline for some general advice and I e maile them for some advice.(posted 7756 days ago)In their reply they stated that under the Limitations Act the time limit in Scotland is 20 years for recovery of land and the principal sum of a mortgage. However, the time limit is 5 years for the recovery of mortgage arrears and costs.
As a Scot with a mortgage shortfall (house bought in Scotland) this seems too good to be true so I'm hoping that a good Scots lawyer might put us right if they see this posting.
Does anyone else have any ideas or opinions on this???
