After a letter a few weeks back saying they were going to call at the house I've just had a phone call from one of their rather rude and aggressive employees. According to them the DPA doesnt cover their keeping phone numbers on file. So I've just signed up for BTs choose to refuse service so when they ring back I can permanently bar their number. Costs £8 per quarter from BT, for those interested ring 150 and it can be set up within 5 minutes.

With reference to your telephone call at 11.06 20th March 2003.

We would like to bring to your attention part of a letter sent on 4th March 2003

“Please note that we have not received the documents to which we are entitled after serving a SARN on your clients the Bradford & Bingley Building Society.

Unfortunately we are not in a position to discuss matters relating to them until we have received the information.”

Please note under the Data Protection Act I am formally demanding that you remove our telephone number from your records. If you fail to do so we will take this matter to the relevant authorities for their investigation.

Due to the seriousness of this matter and any legal action which may arise we will only deal with this matter in writing and will not accept phone calls or personal visits. Should you either visit or phone we will consider this as harassment and make complaints to the Office Of Fair Trading under section 40 of The Administration of Justice Act 1970.

Section 40 of the act provides that a person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under contract, he or she:

(a) harasses the other with demands for payment which by their frequency, or the manner or occasion of their making, or any accompanying threat or publicity are calculated to subject him or his family or household to alarm, distress or humiliation;
