A charging order can be made if the creditor has obtained a CCJ although the creditor needs to apply for one, either at the hearing date or if payment schedule is broken. There is a new law coming into force which will allow any creditor to obtain a charging order even if the payments are kept upto date. In other words in a few years there will be no such thing as an unsecured debt!(posted 7752 days ago)Cant help on original question, may I suggest posting on either www.debthelpuk.co.uk or www.debtquestions.co.uk
