Response to Can anyone help with the 'Spouse Details' questions below?

from Jessie (jessie01@talk21.com)
Lisa, I am in the same position as you ie I have been repossessed and living with my new partner in his home, all the assets are in his name and basically, on paper, I have nothing. I'm not sure if things are different if you are married but what I have been previously advised is that they cannot touch his assets or home, he does not have to fill in an I&E form as the debt is nothing to do with him. As far as I was advised, he does not have to prove any income or expenditure to anyone. I have told the solicitors that he won't give me any info regarding his mortgage repayments etc, they said that if he was not prepared to divulge then I had to send in my salary slips, I asked if this would be classed as 'surplus money' with me not being able to supply any expenditure and they said they know on average what bills are and they wouldn't penalise me, they would leave me so much that they believe I can live on. I must stress that I didn't send in my salary slips and I felt that they were trying to trick me into sending them details so they could slam a bill on me. I am at a lost end because I have offered a full and final which they are refusing to accept without seeing my salary slips - a catch 22 situation.

I wish you luck.

Jessie
