Hidden characters - What did we decide on their legality in MARP recordings?

Well, the other day, I posted about WBML using the hidden character Akuma to record his Street Fighter Zero game with, and I challenged its legality...well, so far it's still up there... So now I've got a question: Let's say I wanted to record on KOF '98 again...and I wanted to use the new ladies team, but I didn't want to use THOSE ladies, I wanted to use the Orochi versions of these 3...would this be allowed? Would the usage of a character like RBFF Mai, or RBFF Billy Kane in KOF '98 be allowed? Heck, would the usage of ANY hidden character in ANY game be allowed? I'm probably not going to use many in my recordings, but I'm just asking, because I'd like to do that in at least one, and I'd like to know if that's allowed...and if so, I could also submit a Bison/Vega recording in Street Fighter Zero if I can get the code...=)
